Wholesale Terms and Conditions for Customer purchases from Giverny, Inc. and its division Mini Me Geology (“Giverny”)

Reseller Status: Prior to placing an initial order, all reseller Customers must either complete a Resale Certificate or provide a resellers retail certificate. The Resale Certificate may be obtained from Giverny. The completed Resale Certificate or resellers retail certificate must only be submitted once.

Orders: Fax or mail orders can be received anytime using our order form. Orders may be placed by telephone to our offices between 9 AM and 3 PM EST Monday through Friday at (888)886-2197. Initial and subsequent orders require $200.00 minimum.

Payment: Payment may be made by credit or debit card (Visa, MasterCard, American Express, or Discover), PayPal, company check, or money order. Giverny does not extend credit terms. Orders placed with a check will not be shipped until the check has cleared the bank. All payments must be made in US Dollars.

Delivery Information: All shipments are FOB Mount Pleasant, South Carolina, USA. Shipping charges will be added at the time of checkout.

Backorders: Backorders will be shipped as soon as possible. Customers must notify Giverny at the time the order is placed if a backorder is not acceptable.

Direct-to-Customer Sales: Giverny reserves the right to sell its products through its internet websites  (www.minimegeology.com), retail stores, and other means. Customers are prohibited from selling any products purchased from Giverny through any on-line third party seller, auction, or clearance website. e.g. Amazon, eBay and Overstock.com et al. You may sell your items in your brick-and-mortar store and on your company website. We do offer limited drop shipping. Please contact us for details.

Damage / Shortage Claims: Giverny takes care to ensure that merchandise is in good condition when shipped. Damaged or missing products must be reported to Giverny within 7 days of delivery. Prior to returning any merchandize, the return must be authorized by Giverny. Damaged or incorrect products will be replaced and/or credited to the customer. If a customer wishes to return an item for any other reason, then the merchandise must be returned to Giverny in its original condition in its original carton with no retail price tags, or any other stickers applied, for credit, refund or replacement. No credit will be given on unauthorized returns or on returns made 14 or more days past the delivery of the product.

Liability: Giverny shall not be liable for failure to deliver or for delays in delivery beyond its control. Giverny’s liability is limited to the wholesale price of any defective goods.

Warranties:Giverny makes no representation or warranty of any kind, expressed or implied with respect to any products, parts or services provided by it including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Products distributed, but not manufactured, by Giverny are not warranted by Giverny and Customer must rely on the representations and warranties, if any, provided directly to Customer by the manufacturer of such product. The sole and exclusive remedy for breach of any warranty is limited to the remedies provided herein.
